{"id":54688,"date":"2025-02-13T09:05:28","date_gmt":"2025-02-13T17:05:28","guid":{"rendered":"https:\/\/vietvalley.com\/vietnamese-author-may-face-prison-for-political-posts-on-facebook\/"},"modified":"2025-02-13T09:05:28","modified_gmt":"2025-02-13T17:05:28","slug":"vietnamese-author-may-face-prison-for-political-posts-on-facebook","status":"publish","type":"post","link":"https:\/\/vietvalley.com\/en\/vietnamese-author-may-face-prison-for-political-posts-on-facebook\/","title":{"rendered":"Vietnamese author may face prison for political posts on Facebook"},"content":{"rendered":"<p><a href=\"https:\/\/www.rfa.org\/vietnamese\/chinh-tri\/2025\/02\/12\/nha-bao-truong-huy-san-bi-truy-to-theo-dieu-331\/\" target=\"_blank\" rel=\"noopener\"><u>Read more on this topic in VIetnamese.<\/u><\/a><\/p>\n<p>A well-known Vietnamese author of a book about the Vietnam War and its consequences is being prosecuted for \u201cabusing democratic freedoms,\u201d state media reported.<\/p>\n<p>Truong Huy San, 64, better known as \u201cThe Winning Side\u201d author Huy Duc, has been detained for more than eight months. <\/p>\n<p>On Wednesday, <a href=\"https:\/\/en.vietnamplus.vn\/man-prosecuted-for-abuse-of-freedom-democracy-rights-post309783.vnp\" target=\"_blank\" rel=\"noopener\"><i><u>VnExpress<\/u><\/i><\/a> reported that the Supreme People\u2019s Procuracy had completed an indictment against San under the loosely worded Article 331 of Vietnam\u2019s Criminal Code. It then transferred the case file to the Hanoi People\u2019s Court for trial.<\/p>\n<p>The indictment said that from 2015 to 2024, San collected information and documents and posted many articles on his personal Facebook page, some with content that \u201cinfringed upon the interests of the state and the rights and legitimate interests of organizations and individuals.\u201d<\/p>\n<p>The articles were widely shared and commented on, which prosecutors said negatively affected security, order and social safety.<\/p>\n<p>In his defense, San \u201cdenied having any anti-Party or anti-State intentions,\u201d <i>VnExpress<\/i> said.<\/p>\n<p>Musician Tuan Khanh told Radio Free Asia that, as a journalist, San had to see both sides of every story.<\/p>\n<p>\u201cA journalist must have his own perspective and his own judgment,\u201d he said. \u201cHuy Duc is accused of taking advantage of democratic freedoms, but I think he only used a small part of the freedom he had to present his views and it cannot be said that he took advantage.\u201d<\/p>\n<p>A Hanoi-based economist, who didn\u2019t want to be identified due to the sensitivity of the subject, said that based on Huy Duc\u2019s writings, the accusation that he was opposing the party, the state and the people was unfounded.<\/p>\n<p>\u201cThe arrest of Huy Duc may be intended to suppress dissenting opinions about changing the political model and may be related to factional struggles before the party congress,\u201d he said, adding that he thought conservative forces within the Communist Party wanted to block the institutional reform proposals that Huy Duc advocated.<\/p>\n<p>\u201cMany leaders make radical statements but it is just a populist stunt. Their actions are not that same as their public statements,\u201d the economist said.<\/p>\n<p>Leaders seeking to consolidate their authority at next year\u2019s party congress can be sensitive to perceived criticism in the run-up. <\/p>\n<p><a href=\"https:\/\/www.hrw.org\/news\/2024\/06\/07\/vietnam-free-prominent-journalist\" target=\"_blank\" rel=\"noopener\"><u>Human Rights Watch<\/u><\/a> and <a href=\"https:\/\/rsf.org\/en\/vietnam-independent-journalist-taken-away-regime-according-rsf-sources\" target=\"_blank\" rel=\"noopener\"><u>Reporters Without Borders<\/u><\/a> have demanded San\u2019s immediate release and on Wednesday writers&#8217; rights group PEN America denounced his indictment<\/p>\n<p>\u201cWhen an author and journalist like Truong Huy San is silenced, it\u2019s not just his voice that is stifled \u2014 it\u2019s the right of an entire society to seek truth and accountability,&#8221; said research and advocacy manager Anh-Thu Vo.<\/p>\n<p>\u201cCriticism is not a crime. Vietnam must stop using its laws as weapons against those who dare to speak the truth.\u201d<\/p>\n<h3><b>Who is \u2018Huy Duc\u2019?<\/b><\/h3>\n<p>The author fought in Cambodia in North Vietnam\u2019s volunteer army, which invaded in late 1978 to oust the Khmer Rouge regime.<\/p>\n<p>He has written for many Vietnamese newspapers, including <i>Tuoi Tre, Thanh Nien, Dien Dan Doanh Nghiep, Nong Thon Ngay Nay, <\/i>and<i> Sai Gon Tiep Thi.<\/i><\/p>\n<p>He released \u201cThe Winning Side\u201d in late 2012, earning acclaim in Vietnam and among the Vietnamese community around the world.<\/p>\n<p>Professor Peter Zinoman, former head of the history department at the University of California, Berkeley, said the book was not like official histories of Vietnam, which characterize the Vietnam War as a conflict between Vietnam and the United States. After being arrested, Hieu was taken to an immigration detention center, Vy said.<\/p>\n<p>\u201cI was summoned by the Dak Lak police who said they suspected Hieu had committed a crime in Cambodia and that\u2019s why he was arrested, but that\u2019s not true. Cambodian police only suspected he was using a fake passport. They didn\u2019t accuse him of doing anything else illegal. It is a false accusation,\u201d she said.<\/p>\n<p>Vy said she helped her brother apply for a passport through the public security ministry\u2019s electronic identification app, VNeID. He received a new passport last July. Police confiscated his previous travel document 12 years ago as he tried to fly to the U.S. to receive the Hellman-Hammett award from Human Rights Watch on behalf of his sister and father Huynh Ngoc Tuan.<\/p>\n<figure><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.rfa.org\/resizer\/v2\/NDAMUNTBLFHMTFJGYGF6U6NFFU.jpg?auth=058d55e5782ac8ec8bcd66c44885c3ddc0f091bef74960fd5102cca9343b1114&amp;smart=true&amp;width=1500\" alt=\"Activist and blogger Huynh Trong Hieu in a photo taken in June 2024.\" height=\"1334\" width=\"1500\" \/><figcaption>Activist and blogger Huynh Trong Hieu in a photo taken in June 2024.<\/figcaption><small>(Facebook: Huynh Thuc Vy)<\/small><\/figure>\n<p>Last November, the U.S. Consulate General in Ho Chi Minh City issued Hieu a B1\/B2 tourism\/conference visa, Vy said, showing RFA photographs of the document and passport.<\/p>\n<p>\u201cIf it is a fake passport, the responsibility lies with the Vietnamese Ministry of Public Security,\u201d Vy said. \u201cOur family requests that the Vietnamese Ministry of Public Security, in coordination with the Vietnamese Embassy in Cambodia, find a way to bring Hieu safely back home.\u201d<\/p>\n<p>Radio Free Asia\u2019s Khmer service contacted a spokesman for the Cambodian Ministry of Interior\u2019s Immigration Department, Sok Someakhea, and the Ministry of Interior\u2019s spokesperson Touch Sokhak to ask about Hieu\u2019s case but they didn\u2019t reply.<\/p>\n<p>Minister of the State for the Civil Aviation Authority of Cambodia, Sao Wathana, on Wednesday confirmed Hieu\u2019s arrest by immigration police to <a href=\"https:\/\/cambojanews.com\/prominent-vietnamese-activist-detained-at-phnom-penh-airport\" target=\"_blank\" rel=\"noopener\"><u>the Cambodian Journalists Union Association<\/u><\/a>. He said he had forwarded reporters\u2019 questions to the head of the relevant immigration agency.<\/p>\n<p>RFA\u2019s Vietnamese service emailed the Ministry of Foreign Affairs and Ministry of Public Security to ask about Hieu\u2019s case but didn\u2019t receive a reply by time of publication.<\/p>\n<p><i><b>Translated by RFA Vietnamese.
